Terms and Conditions for Participation in Discount Promotions in the Online Shop www.chocolissimo.cz

§ 1 Scope and General Provisions

1. These Terms and Conditions govern the organisation and use of discount promotions (hereinafter referred to as “Promotions”) offered by the operator of the online shop at chcolissimo.cz (hereinafter referred to as the “Seller”). The offer is provided by MM Brown Spółka z o.o. z siedzibą przy ul. Ostrowskiej 582, 61-324 Poznań, wpisana przez Sąd Rejonowy w Poznaniu, XXI Wydział Gospodarczy Krajowego Rejestru Sądowego - Rejestru Przedsiębiorców pod numerem KRS: 0000671307, NIP: PL 7822424244, REGON: 300797727.

2. Participation in discount Promotions is governed exclusively by these Terms and Conditions and the Seller's General Terms and Conditions. Any conflicting general terms and conditions of customers shall not apply unless expressly agreed to in writing.

3. The Seller reserves the right to amend these Terms and Conditions at any time with effect for future Promotions, where necessary for legal, factual or technical reasons.

4. For Promotions that have already commenced or are ongoing, the Terms and Conditions published at the start of the respective Promotion shall apply.

§ 3 General Types of Promotions

The following discount Promotions may be offered individually or combined under certain conditions in the online shop:

1. Discount Codes

a) Discount codes may provide percentage-based or fixed-amount discounts (e.g. 10% or €10) on specific products or product groups.

b) Discount codes cannot be combined with other Promotions or discount codes unless otherwise stated.

c) Only one discount code may be redeemed per order.

d) Retroactive application of discounts to orders already placed is excluded.

e) The resale or public distribution of discount codes is prohibited.

2. Free Shipping

a) Free shipping is automatically applied during checkout when a specified minimum order value is exceeded (e.g. orders over €50).

b) The minimum order value refers to the value of the products excluding shipping costs and before the deduction of any additional discounts.

c) In the event of a full or partial withdrawal from an order, eligibility for free shipping may be lost if the remaining order value falls below the required minimum. In such cases, shipping costs may be charged retrospectively.

3. Percentage Discount on the Shopping Cart

a) The discount applies to the entire shopping cart once a specified minimum order value has been reached (e.g. 20% off orders over €100).

b) Certain appropriately marked products may be excluded from additional discounts.

c) The minimum order value refers to the value of the products excluding shipping costs.

§ 4 Eligibility Requirements and Exclusions

1. Discount Promotions apply exclusively to orders placed during the valid promotional period directly through the Seller's online shop at chocolissimo.cz

2. Discount Promotions are intended exclusively for end consumers and not for resellers or business customers, unless the Seller has expressly agreed otherwise. End consumers are natural persons who are at least 18 years old, have full legal capacity and purchase goods for their own private use.

3. Cash payments, refunds of discount values or retroactive application of discounts are excluded. The Seller is entitled to exclude individual customers from discount Promotions, including retrospectively, where there are valid reasons, such as violations of these Terms and Conditions, the provision of incorrect, dishonest or unlawful information, or the obtaining of unfair advantages. In such cases, or where other valid reasons exist, the Seller is entitled to revoke any discount granted, demand repayment of its value and initiate legal proceedings.

4. Discount Promotions are non-transferable.

5. In the event of suspected manipulation, misuse or other unlawful or unethical conduct, the Seller reserves the right to exclude customers from a Promotion or retrospectively revoke discounts already granted. Misuse includes, in particular, repeatedly redeeming a discount by circumventing technical restrictions or obtaining an unauthorised advantage by providing false information.

§ 5 Promotional Period

1. The specific duration of each Promotion is determined by the conditions stated in the respective promotional offer. These conditions are clearly indicated in the promotional materials (e.g. banners, newsletters or product pages).

2. If no specific end date is stated, the Promotion shall remain valid “while stocks last”. The termination of a discount Promotion is at the Seller's discretion. Customers shall have no entitlement to benefit from a Promotion if the relevant goods are no longer in stock or are no longer included in the Promotion. The Seller reserves the right to make changes at any time.

3. The Seller reserves the right to terminate or extend discount Promotions early where there is an objectively justified reason (e.g. products selling out, technical errors or attempted misuse).
